The traditional instrument is the rogatory commission. It is a mechanism in which a Court requests another Court in a foreign country to carry out an investigative or evidentiary procedure. There are regulatory provisions regarding the formality of the request, which must include the identification of the issuing and requested judicial body, as well as the completion of the required diligence.

It is necessary to emphasize that the rogatory commissions must contain a sufficient summary of the case that allows the requested judge to understand the scope of what is requested in relation to the object of the procedure. Only in this way will the requested evidence allow the requested judge to control the need, opportunity and convenience of attending to the request for rogatory commission. But the content of the request does not end here, as it must include the identity of the witnesses, if applicable, or the specification of the documents requested. You can read the article here
